1. GRAPHIC DESIGN AGREEMENT
This Graphic Design Agreement (the “Agreement”) is entered into on the date the initial deposit is submitted by and between you (the “Client”) and Arq Design Studio Corp. (the “Designer”), collectively “the Parties.”
 
2. PROJECT DESCRIPTION
By submitting this Agreement, the Designer agrees to spend the listed amount of time on your scheduled date(s) on design-related assignments to be determined by the Client & Designer together, as well as up to 1 hour of prep work prior to the Intensive. In addition, all projects will include a period of time post-project where the Designer agrees to offer Slack or email support for questions or concerns about the work we complete together. For 1-day design projects, this includes 7 days of post-project support. For 1-week design sessions, this includes 15 days of post-project support. This support period does not include new design work as this would need to be added on separately.
Collaboration will normally occur between the hours of 9am – 5pm EST on the Client’s specified project date(s), though the number of hours in each day will vary depending on the project booked. 1-day projects will last 8 hours, which includes a 1-hour lunch break. 1-week projects are not based on a set number of hours, as each day during the week will require a different length of time, but we will dedicate an appropriate amount of time during each day for project tasks and will be available via ClickUp throughout our project week. These timeframes can be adjusted if agreed upon in writing by both the Client & Designer to adjust for time zone differences. Detailed schedule information will be provided in your client dashboard after booking.
 
3. REFUNDS & RESCHEDULING
This purchase is non-refundable, but may be rescheduled to another date or applied to a different service offering with written notice within 7 days of the scheduled intensive date. If emergent circumstances occur for either Party or require the date to be rescheduled after the 7 day window has passed, the Designer can, at their discretion, schedule a new date with the Client within a 90-day period of the original intensive date. If a new date is not secured within that 90-day period, the deposit will be forfeited & the intensive cancelled.
 
4. PAYMENT
Payment for these services will be to Service Provider at the rate listed on the MARA website (not including any valid coupons applicable to this product or add-ons chosen by the Client) and a minimum of one deposit toward the project will be due at the time of booking this project. This can be paid in full upon booking or split into two installments, with 50% due to reserve your spot & the remaining 50% automatically withdrawn by the payment processor 30 days after the initial deposit payment.
 
5. ADDITIONAL EXPENSES
The Designer agrees to discuss upfront any additional expenses that may be incurred for items such as stock photography, font licensing, plugin licenses, web hosting, or other third party services. These costs are the responsibility of the Client & will be billed separately from the Design Intensive rate.
 
6. COMMUNICATION
The Client and Designer will primarily communicate via a shared ClickUp channel during the prep phase, during the project timeframe, as well as during the support phase post-project. An invitation to this ClickUp project will be sent within approximately 2-5 business days of booking. The Designer and Client can also schedule phone or video calls on the platform of their choosing, at times agreed upon by both parties. The Designer is not expected to reply to messages or check ClickUp, email, or similar outside of business hours (9am to 5pm EST) but aims to respond to messages in a timely manner.
 
7. OWNERSHIP
Client continues to own any and all proprietary information it shares with Designer during the term of this Agreement for the purposes of the Agreement. Designer has no rights to this proprietary information and may not use it except to complete the Graphic Design services. Upon completion of the Agreement, Client will own the final Graphic Design Deliverables. While Designer will customize Client’s Graphic Design Deliverables to Client’s specifications, Client recognizes that Graphic Designs generally can have a common structure and basis. Designer continues to own any and all baseline template designs it may have created prior to this Agreement. Designer will further own any template designs it may create as a result of this Agreement. Lastly, Client grants permission for Designer to display the design work created in portfolios or promotional displays showcasing the designer’s work, provided it does not reveal any proprietary or confidential information.
 
8. ENTIRE AGREEMENT
The Parties acknowledge and agree that this Agreement represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.

  • What kind of results can I expect?
    f you have an email list already warmed up:
    If you're already seeing 30% of owned revenue from email, we have worked with customers to push that to 40% of owned revenue in combination with campaigns and advanced flows.If you're starting a new list:
    You should see your Klaviyo channel generating between 20-30% of the Gross revenue of your online store within 1-2 months of completing a setup or VIP weekend. We guarantee at least 15% owned revenue if you have a small email list <500 subscribers and subscriber growth in the first month if you have >100 visits per week.
  • How often to I need to revisit my flows?
    Hopefully only 1x a year! Although flows are designed to be a one-time service, we recommend sending out scheduled calendar emails (what we call campaigns) at least 1x a week to keep your list warm, generate good deliverability, and remain top-of-mind for your customers. If you want more support with ongoing email services, at. the culmination of this project we would be happy to chat about ongoing email services!
  • Do you guarantee results?
    While email is not an exact art, we absolutely guarantee results. Much of your email revenue depends on list quality, traffic sources, offer quality, and frequency. While every situation is different, we guarantee a significant and measurable increase in your owned revenue on Klvaiyo.
  • Do you work with platforms other than Shopify?
    No, this service is ONLY for Shopify entrepreneurs who want to run integrated and automated marketing campaigns with Klaviyo to scale their income without scaling their team or marketing spend. We can’t guarantee setup and scalability with other providers like Lightspeed, MailChimp, or Flodesk.
  • How soon will the service be completed?
    Our service runs approximately a week long - from Tuesday to Friday. We only book up to 3 email services a month, and those fill up 2-4 weeks in advance. You can always email hello@arqdesign.studio, or check our Instagram page, to see our next available dates (subject to change)!
  • Will I have support after the service is complete?
